This Privacy Policy explains how we collect, use, share, and protect your information when you use our web application, mobile applications, websites, webinars, live events, coaching services, educational content, consulting services, done-for-you services, and any other products or services we offer (collectively, the "Services").

By using our Services, you consent to the data practices described in this Privacy Policy. If you do not agree with our practices, please do not use our Services.

1. INFORMATION WE COLLECT

1.1 Information You Provide

We collect information you directly provide to us, including:

  • Photos and Content: Images you upload for editing, profile information, and any content you create using our tools

1.2 Information We Collect Automatically

When you use our Services, we automatically collect:

  • Usage Data: Features used, actions taken, time spent, and interaction patterns

Special considerations apply to photos and content you upload:

  • Processing: Your photos are processed by our AI systems and human editors to provide our Services
  • Storage: We store your photos securely to deliver our Services and allow you to access your edited content
  • Deletion: You can delete your photos at any time through your account settings
  • No Unauthorized Use: We do not use your photos for any purpose other than providing our Services to you
  • Confidentiality: Our editors are bound by confidentiality agreements

6. BIOMETRIC DATA AND FACIAL RECOGNITION

IMPORTANT NOTICE REGARDING BIOMETRIC DATA: Our Services involve the processing of photographs containing your facial features. By uploading photos and using our AI-powered Services, you acknowledge and consent to the collection and processing of biometric data as described below.

6.1 What Biometric Data We Collect

When you upload photos to our Services, our AI systems may extract and process biometric identifiers and biometric information, including but not limited to:

  • Facial geometry and facial feature measurements
  • Facial landmarks and proportions
  • Skin tone, texture, and lighting characteristics
  • Other facial data points necessary to generate AI-edited images that accurately represent your likeness

6.2 Purpose of Collection

We collect and process biometric data for the following purposes:

  • Training your personal AI model to generate photos that accurately represent your appearance
  • Creating AI-generated and AI-edited images through our Image Studio (DIY and DFY services)
  • Improving the quality and accuracy of AI-generated outputs
  • Ensuring generated images maintain a faithful likeness to your actual appearance
  • Identity verification and ban enforcement: We may use biometric data to verify user identity and to detect and prevent banned individuals from creating new accounts or otherwise circumventing account terminations. This includes comparing biometric data from new account registrations against records of previously banned users.

6.3 Consent

By uploading photos to our Services, you provide your informed, written consent to the collection, storage, and processing of your biometric data as described in this section. You may withdraw consent at any time by deleting your photos and requesting account deletion by contacting support@onepercent.dating. Withdrawal of consent will result in the inability to use features that require biometric data processing.

6.4 Storage and Retention

Biometric data derived from your photos is retained only for as long as necessary to provide our Services to you. Specifically:

  • AI training data associated with your account is retained while your account is active
  • Upon voluntary account deletion, biometric data and AI training models specific to your likeness will be permanently destroyed within 90 days
  • For accounts terminated due to policy violations, we may retain biometric identifiers indefinitely for the purpose of preventing the banned individual from re-registering or circumventing the ban
  • We do not retain biometric data beyond the purposes for which it was collected as described in this section

6.5 Protection and Sharing

We protect biometric data using industry-standard security measures, including encryption in transit and at rest. We do not sell, lease, trade, or otherwise profit from your biometric data. Biometric data is not shared with third parties except:

  • With AI infrastructure providers who process data on our behalf under strict contractual obligations
  • As required by law, court order, or governmental regulation

6.6 Your Rights Regarding Biometric Data

Depending on your jurisdiction, you may have additional rights regarding biometric data, including the right to request information about what biometric data we hold, the right to request deletion, and the right to withdraw consent. To exercise these rights, contact support@onepercent.dating.

7. DATA RETENTION

We retain your information for as long as necessary to provide our Services and comply with legal obligations:

  • Active Accounts: We keep your information while your account is active
  • Deleted Content / Closed Accounts: When you delete content or close your account, we remove personal profile data (photos, profile details, preferences) from active systems within 45 days
  • Transactional Records: We retain transaction records, payment history, service delivery logs, and related communications for 24 months from the date of the last transaction, as required for payment processor compliance, chargeback defense, fraud prevention, and legal obligations
  • Tax / Accounting Records: Financial records may be retained for up to 7 years per IRS requirements
  • Backups: Deleted information may persist in backups for a limited time

8. YOUR RIGHTS AND CHOICES

8.1 Access and Update

You can access and update your information through your account settings or by contacting us.

8.2 Delete Your Account

You can request deletion of your account and personal profile data (photos, profile details, preferences) by emailing support@onepercent.dating. Please note that deletion requests apply to personal and profile data; transactional records (payment history, service delivery logs, and related communications) are retained as described in Section 7 under our legal basis for compliance, chargeback defense, and fraud prevention.

8.3 Marketing Communications

You can opt-out of promotional emails by clicking "unsubscribe" or updating your preferences. Service-related communications cannot be opted out of while you maintain an account.

8.4 Data Portability

You can request a copy of your data in a structured, machine-readable format.

9. INTERNATIONAL DATA TRANSFERS

We operate globally and may transfer your information to countries other than your own. We ensure appropriate safeguards are in place for international transfers, including standard contractual clauses where required.

10. CHILDREN'S PRIVACY

Our Services are not intended for anyone under 18 years old. We do not knowingly collect information from children. If we learn we have collected information from a child under 18, we will delete it promptly.

11. CALIFORNIA PRIVACY RIGHTS

California residents have additional rights under the California Consumer Privacy Act (CCPA):

  • Right to request deletion of your personal information
  • Right to opt-out of the sale of personal information (we do not sell personal information)

13. AI AND AUTOMATED PROCESSING

Our Services make extensive use of artificial intelligence and machine learning technologies. By using our Services, you acknowledge and agree that:

  • AI Image Generation: We use machine learning models to generate and edit photographs based on your uploaded images. These models analyze facial features, body proportions, lighting, and other visual characteristics to produce outputs.
  • AI Model Training: When you upload photos, we may train a personalized AI model specific to your likeness. This model is used exclusively to generate images for your account.
  • Messaging Assistant: Our Wingman Messaging Assistant uses large language models to analyze conversation screenshots and generate suggested responses. Conversation data is processed to provide this service.
  • Automated Analysis: We may use automated systems to analyze usage patterns, detect fraud, enforce our Terms of Service, and improve our Services.

No solely automated decisions with legal or similarly significant effects are made about you without human review. You have the right to request human review of any automated decision that significantly affects you by contacting support@onepercent.dating.

14. COOKIES AND TRACKING

We use cookies and similar technologies to:

  • Keep you logged in
  • Remember your preferences
  • Understand how you use our Services
  • Deliver relevant content

You can control cookies through your browser settings, but disabling them may limit functionality.

14.1 Do Not Track Signals

Some browsers transmit "Do Not Track" (DNT) signals to websites. There is currently no industry standard for how companies should respond to DNT signals. At this time, our Services do not respond to DNT signals. However, you can control tracking through your browser cookie settings and the opt-out mechanisms described above.

15. SMS / TEXT MESSAGING

15.1 How We Obtain SMS Consent

We collect your phone number through sign-up forms on our website (e.g. webinar registration). Providing your phone number alone does not constitute consent to receive SMS messages. SMS consent is collected separately through explicit opt-in checkboxes at the point of collection, where you may independently consent to:

  • Transactional Messages: Service-related messages such as webinar reminders, account alerts, and notifications
  • Marketing Messages: Promotional content, offers, and updates about our Services

Neither checkbox is required to complete a form submission. Marketing consent is never pre-checked. We record the timestamp, source page, and consent type for each opt-in.

15.2 How We Use SMS Consent

We use your SMS consent only for the specific message types you opted into. Transactional consent is used to send service-related communications. Marketing consent is used to send promotional messages. We do not combine these consent types or use one to justify the other.

15.3 Phone Number Sharing

We do not sell, rent, or share your phone number with third parties for their marketing purposes. Your phone number is shared only with our SMS delivery provider solely for the purpose of transmitting messages you have consented to receive. No other third parties receive your phone number.

15.4 Opting Out of SMS

You can opt out of SMS messages at any time by replying STOP to any message you receive from us. You may also contact us at support@onepercent.dating to request removal. After opting out, you will receive one final confirmation message and no further SMS communications of that type. Opting out of SMS does not affect your account or access to our Services.

16. THIRD-PARTY LINKS

Our Services may contain links to third-party websites. We are not responsible for their privacy practices. We encourage you to read their privacy policies.

17. DATA BREACH NOTIFICATION

In the event of a data breach that affects your personal information, we will:

  • Investigate and take steps to contain and remediate the breach as quickly as reasonably possible
  • Notify affected users as required by applicable law (including within 72 hours where required by GDPR)
  • Notify relevant supervisory authorities and law enforcement as required by applicable law
  • Provide information about what data was affected, what steps we are taking, and what you can do to protect yourself

Notification may be made via email, in-app notification, or posting on our website, depending on the circumstances and applicable legal requirements.

18. CHANGES TO THIS POLICY

We reserve the right to modify this Privacy Policy at any time, at our sole discretion, with or without notice. Changes become effective immediately upon posting to our website. It is your responsibility to review this policy periodically for updates. Your continued access to or use of our Services after any modifications are posted constitutes your acceptance of the revised policy.
